By using this Site, you agree to review these provisions periodically to ensure that you are aware of any modifications.

Your use of the Site, the Content, and any product or service discussed or promoted via the Site is your own responsibility.
When using the Site, information will be transmitted over a medium that is beyond the control and jurisdiction of Smart Living Network and its suppliers. Accordingly, Smart Living Network assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the Site. You should ensure that you have appropriate safeguards on any computer or other electronic medium to avoid any defect that adversely affects your computer system.
Therefore, Smart Living Network disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranty, or merchantability, to the fullest extent permitted by law.

Under no circumstances shall Smart Living Network or any third parties be liable for any damages, compensation or costs (including, without limitation, incidental and consequential damages, personal injury/wrongful death, loss of profits, or damages resulting from lost data or business interruption) resulting from the use, reliance, misuse or inability to use the Site or the Content, whether based on contract, tort, statute or any other legal basis and whether or not Smart Living Network is advised of the possibility of such damages.
To the extent permitted by law and at the discretion of Smart Living Network, remedies are limited to the replacement of the product or supply of an equivalent product or payment of the cost of such replacement or supply. By using this Site, you acknowledge that, except as aforesaid, Smart Living Network is not liable for any costs expense loss or damage of whatsoever nature, whether direct, indirect or consequential, caused by or resulting from breach of any condition or warranty. Any claims arising in connection with your use of the Site or any Content must be brought within one (1) year of the date the event giving rise to such action occurred. Remedies under these Terms of Service are exclusive and are limited to those expressly provided for in these Terms.
This Privacy Guideline ("Privacy Guideline") applies to all personally identifiable information (collectively, "Personal Data") and other information that is collected through the Site of Smart Living Network. Please read this Privacy Guideline carefully before using the Site. By using the Site, you (hereinafter, "you" or "user") consent to our practices described herein.
By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Guideline. If you provide Personal Data to us via this Site, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Smart Living Network and the authorized third parties referred to herein for the purposes described in this Privacy Guideline.

Collection of Personal Data
We collect Personal Data from you when you voluntarily choose to provide such information, such as when you enter your Personal Data on our Site. Wherever we collect Personal Data we make an effort to provide a link to this Privacy Guideline. So that we can provide you with optimal service and Content, Smart Living Network may request information about you. Information we collect includes Personal Data such as names, postal addresses, email addresses and demographic information such as age, gender and zip code. We also may collect technical data such as your IP address, browser type, domain name, access times and referring Web site address.
This information is collected both during member registration on the Site, when opting in to receive a newsletter, when opting in to receive special offers from Smart Living Network and/or Smart Living Network partners, when entering a Smart Living Network sweepstakes or contest, or when completing a Smart Living Network survey. Personal Data collected via the Site will be available within the network of web sites operated by Smart Living Network for use in accordance with the terms of this Privacy Guideline.
What We Do With Your Personal Data
We may use Personal Data in order to display custom, personalized content to our visitors. We may also use Personal Data to send newsletters, emails, features, promotional material, surveys and other updates to users who opt in to receive information from Smart Living Network. A user may opt-out of receiving such information at any time.

Agents, Consultants and Related Third Parties: Smart Living Network sometimes hires other companies to perform certain business-related functions. Examples include mailing information, maintaining databases and processing payments. When we employ another company to perform a function of this nature, we endeavor to provide them only with the information that they need to perform their specific function.
Legal Requirements: Smart Living Network reserves the right to use or disclose your Personal Data without notice or consent as needed to comply with federal and state law; to conduct investigations of consumer complaints; to protect the integrity of our site; to protect the safety of our visitors or others; and to cooperate in any legal investigation.
Controlling Your Personal Data
A user may change, correct, modify, or delete any Personal Data they may have provided to Smart Living Network by contacting us via the "contact us" page on our website(s). Users can also unsubscribe from any newsletters or opt out of various promotional emails by following the directions provided in each mailing.
As a non-member visitor, you may comment or stamp blogs. Before you do so however, you must respond fully to the network's prompt - enter your name and email address and demonstrate you agree to our TOS by checking the appropriate box. In doing so, you will be treated as a member from there on. An account will be created for you and a password will be sent to your account for future use.
Website Traffic Analysis
We may automatically gather general statistical information about our website and visitors, such as, browsers, pages viewed, number of visitors, goods and services purchased, transactions completed, etc. To do this, we use action tags and cookies provided by our site analytics software and marketing partners. Although these partners log the information coming from our site on our behalf, we authorize how that data may and may not be used.
As is true of most web sites, we gather certain information automatically and store it in log files. This information includes date/time stamps, browser types, operating systems, internet protocol (IP) addresses, internet service providers (ISPs), referring/exit pages, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, and to track user's movements around the site. We do not link this automatically-collected data to personally identifiable information.
Some of our websites use ClickTale® web analytics service. ClickTale may record mouse clicks, mouse movements, and scrolling activity on this website. ClickTale does not collect personally identifiable information, nor is it used on pages where personally identifiable or financial information is entered. ClickTale does not track your browsing habits across web sites which do not use ClickTale services. We are using the information collected by ClickTale service to analyze trends and provide a better website experience for visitors. Visitors Outside Of The United States
The Site and the servers upon which this Site is hosted are located in the United States. All matters and material related to the Site is governed by the laws of the State of Michigan in the United States. Any information users outside of the U.S. provide will be transferred to the United States, and by visiting this Site and submitting Personal Data and other information, you authorize this transfer.
Children And Privacy
Smart Living Network complies with the Children's Online Privacy Protection Act of 1998 (COPPA). COPPA is a federal law that protects the privacy of children using the Internet. The Site is directed at an adult market and is intended for use by adults only. We do not collect Personal Data from anyone under 13, nor do we allow children under 13 to participate in forums or chat rooms without prior verified parental consent. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Guideline by instructing their children to never provide Personal Data on this Site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to Smart Living Network through this Site, please contact us, and we will endeavor to delete that information from our databases.

We take reasonable steps to protect the security of your Personal Data. Since no data transmission over the Internet can be guaranteed to be totally secure, we do not promise that the Personal Data you provide to us will always be totally secure. Therefore, you should therefore take special care in deciding what information you send to us via the Internet.
Links To Third Party Web Sites
This Privacy Guideline shall not apply to any unsolicited information (such as comments and feedback) you provide to Smart Living Network through this Site and/or that you post to any public areas of the Site, such as bulletin boards (collectively, "Unsolicited Information"). All such Unsolicited Information shall be deemed to be non-confidential and Smart Living Network shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution. You should be aware that if you voluntarily disclose Unsolicited Information online, that Unsolicited Information can be collected and used by others. For example, if you post your email address in chat rooms or online forums, you may receive unsolicited messages from others. Smart Living Network has no control over the use of Personal Data that you voluntarily post in public forums.

60-Day Satisfaction Guarantee
Smart Living Network offers new customers, a 60-Day satisfaction guarantee on all unopened products and two bottles/packages of opened product.
Our "60-day satisfaction guarantee" means you will be 100% satisfied with your purchase, or you may return the product for a refund of your purchase price (less shipping and return processing fee).
Any follow up purchase of like product(s) after your first regular sales purchase, is not covered by the guarantee. Your second purchase is a clear and final indication that you accept the product(s) as is.
There are no refunds for Non-Consumable items like Shirts, Wristbands etc.. .
There is no special return policy for promotional sales we run. Same rules apply as regular orders. If it is the customer's second order of a product, we don't offer a refund. We don't refund shipping. It's just the same as regular orders, just the price if different.
Undeliverable or Refused Packages
Refused or undeliverable orders will be refunded according to this policy, less all shipping and handling and a return processing fee. The customer is responsible for providing a deliverable a postal address when placing the order.
Please add our product to your daily regimen for a minimum of one month. Because we ask you to give our products a minimum of one month, we do not accept returns until this 30-day period has been completed.
If you are not totally satisfied after at least 30 days of using the product, you may return the empty bottles/packages along with the sealed, unused bottles/packages for a refund.
Our Satisfaction Guarantee is designed for a single user for 60 days use of product. Therefore, only two bottles/packages of your product can be opened to be eligible for a refund. All other packages/bottles of the same product must be in the factory-sealed container to be eligible for refund.
You have 60 days from when your product was shipped to request a Return Merchandise Authorization for a refund. We do not issue RMA numbers past this 60 day period.
All returns are charged a return processing fee. This fee will be 20% of the total product purchase price. We do not refund the cost of shipping or handling.
To begin your return, please complete these steps:
- Call our Customer Service at 866-504-7557 in the U.S. or 616-551-4246 outside of the U.S. to receive your RMA (Return Merchandise Authorization) number. Display this number visibly on the outside of the return package. Packages sent to us without a visible RMA number will not be accepted and will be discarded. Your RMA number will expire 14 days after your request. Your RMA number will expire 14 days after being issued.
- If we do not receive your return package within 14 days of issuing the RMA, your purchase will no longer be eligible for a refund, regardless of the 60 day satisfaction guarantee.
- In order for your return to be accepted, you must ship back all of the empty bottles/packages and any unused, unopened bottles/packages in their factory-sealed containers, along with an RMA form. DOWNLOAD RMA FORM (PDF)
- We strongly recommend returning packages to us through certified mail with a tracking number. If we do not receive your product, and you cannot prove your product was returned, we will not issue a refund.

Returns will be processed and refunds issued within 30 business days of return package receipt. Refunds will be issued in the same form as the original purchase payment method. If this payment method is closed for any reason, we will issue a company check for payment.

We strive to fulfill your order correctly and quickly. In order to maintain the best service, we have set guidelines in our order processing. To thoroughly process your order we need several key elements from you. All must be valid and are listed as follows: first name, last name, email address, phone number, billing address, and a delivery address if different from the billing address.
We ship via USPS, so a valid postal address is required for all orders. FedEX® may be used for special orders, but additional fees may be required. You have 30 days after ordering to contact us if you have not received your product. If we have confirmation your package was delivered we are no longer responsible for your product.
FedEx® will make three attempts to deliver your order before the package is returned to the company; USPS will make one attempt. Customers are issued a refund if their package is returned (less shipping). We cannot reship orders that are returned to us as undeliverable.
International Orders: Customs Fees and Guidelines
Tax and duties for international orders are not included in the shipping charge. Customers are responsible for any additional Customs fees. A separate invoice for the tax and duties (Customs fees) will be charged to you from either USPS or FedEx® or your country's Customs office.
Customs restrictions and warranty issues prevent us from shipping to every international location.
Do not order items that are illegal to import into your country. Laws vary from country to country, and it is your responsibility to check with your Customs office to see if your country permits the importation of our products. We do not encounter problems with Customs when shipping to most countries.
If the package is seized by Customs for any reason and is returned to us, we will issue you a prompt refund, less shipping costs and any Customs fees charged to Smart Living Network® by your country. If the package is not returned to us, we cannot issue you a refund. Most orders are held by Customs for the purpose of charging import duties and Customs fees. Please contact the Customs Office in your country about duties and fees before ordering, as we are not responsible for these charges.
If your package is delivered to you and USPS or FedEx® has paid the Customs fees on your behalf, to ensure prompt delivery of your order, you will be responsible to pay the custom fees to USPS or FedEx®. If you do not pay the Customs fees Smart Living Network® will charge those fees to the credit card you used when placing your order.
All of our products sold internationally are meant for personal use - up to a 90 day supply of each product may be purchased at one time. For international retail opportunities, please call 1-800-801-8820.
Fraud is taken very seriously. Anti-fraud measures are in place at multiple levels and at different stages of the transaction with our merchant account partners.
If you wish to cancel your order, please call our Customer Service at 866-504-7557 in the U.S. or 616-551-4246 outside of the U.S. Your cancellation must be made before your order ships. If the product has not shipped, a refund will be issued by the same method of payment the order was originally charged.
If a cancellation is placed after the order shipped, it is up to the customer to refuse the unopened package or send unopened package back. Once the package is returned, a full refund will be issued, less shipping costs (see Free Shipping and Cancelled Orders below), both to and from your delivery address. All cancellation refunds are processed within five business days. We reserve the right to cancel any order at any time.
Once a package has been opened, it is no longer eligible for cancellation. At this point, our standard returns policy applies.
Free Shipping and Cancelled orders: Free shipping is a reward for customers who use our products, and does not apply to cancelled orders. Cancellation refunds on orders that have already shipped will be debited either the published shipping rate or the actual shipping costs, whichever is greater. This applies to both domestic and international orders.
International orders: You are responsible for any customs fees, taxes, and return shipping charges incurred to return the package. Due to the cost of returning packages deemed undeliverable or refused at customs offices, any refused or undeliverable package automatically disqualifies your purchase from refund eligibility.
Advertisements, Promotions and Links
Smart Living Network discusses certain products and/or services of third parties on the Site. In occasional cases the third-party product and/or service provider will pay Smart Living Network a referral fee for purchases made by individuals that are referred to it by Smart Living Network. As noted above, Smart Living Network makes no representations or warranties regarding the efficacy of these products and/or services, and your use or reliance upon any product or service that is discussed or promoted via the Site is at your own discretion and is subject to these Terms of Service. Other than as noted herein, Smart Living Network does not endorse content on any third-party web sites. Smart Living Network is not responsible for the content linked in or out of any third-party sites; sites framed within the Smart Living Network Site, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party web sites is at your own discretion and subject to the Terms and Conditions of use for such sites.
User Submissions and Contributions
Any information provided is subject to our Privacy Guideline. Beyond that information, any email or other communications or content you send to any part of this Site, is non-confidential for all purposes. If you make any such submission, you automatically grant, agree and warrant that the owner of such content has expressly granted or agreed Smart Living Network a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form, format or forum now known or hereafter developed. Smart Living Network may sublicense its rights through multiple tiers of sublicenses.
You agree to defend, indemnify and hold Smart Living Network, its officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your breach of or default under these Terms of Service.
Smart Living Network makes no claims that Content is appropriate or may be downloaded in any country or jurisdiction. Access to Content may not be legal by certain persons or in certain countries. If you access the Site you do so at your own risk and are responsible for compliance with the laws of your country's jurisdiction. Smart Living Network is not liable for any direct, indirect, incidental, special or consequential damages of any kind whatsoever (including, without limitation, attorneys' fees and lost profits or savings) in any way due to, resulting from, or arising in connection with this site, including its original and third party content, regardless of any negligence of Smart Living Network.
Any claim or controversy arising out of or related to these Terms of Service, the Site, or the services or products provided on or through the Site shall be settled by binding arbitration to be held the USA, and these terms and conditions shall be governed by and construed in accordance with the laws of the State of Michigan, as they apply to agreements made and solely performed therein. Disputes arising hereunder shall be exclusively subject to the jurisdiction of the courts in the State of Michigan. This will include any connection with any such dispute including any claim involving Smart Living Network or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.
If any provision of these Terms of Service is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect.
